Terms & conditions
Terms and Conditions are dictated by the property owners, the agents of GO NAKED, the applicable laws of the CIty of New York, the State of New York, and the United States, and the laws of the nation of Honduras, its states, territories, and municipalities as applicable.
All parties assume full liability for their safety, security, well being, and health and do hereby indemnify GO NAKED its agents, actors, owners, administrators, contractors, or other affiliated parties of all wrongdoing where applicable by New York State Law, Federal Code, and the Laws of Honduras.
All parties assume personal responsibility and liability for travel requirements, VISAs, passport control, vaccinations, medications, and other health necessities as deemed necessary by the US State Department or other Nation of Origin, as applicable, for travel to Honduras.
All emergent medical situations are the full and total financial responsibility of the individual involved. Any costs incurred as a result of medical emergencies or other medical crises will be assumed by the person(s) directly involved.
All parties assume full responsibility for their behavior and conduct during the full term of this tour and recognize that excessive alcohol, drug use, sexual conduct, or other behavior deemed unsavory, intolerable, unsafe, or otherwise disruptive to the collective may result in immediate expulsion from the island at their own cost, if a ⅔ majority agree that the offending party must leave. Individual actions resulting in the expulsion of the entire group can result in libel suits to recover additional costs to all group members.
All parties recognize that that this is a sex-positive travel excursion and will abide by the social norms established within the group upon arrival. Participants in public sex visible to travelers, locals, authorities or others beyond the island assume the risk of the laws of the land and those individuals alone will assume full legal and financial responsibility for their actions.
Refunds are granted 90 days in advance with a 10% full fare fee, 60 days in advance with a 25% full fare fee, and 30 days in advance with a 30% full fare fee. No refunds after 30 days in advance. Package is fully transferable to another party up to 48 hours in advance.. Prices are subject to change pending circumstances beyond our control. Additional fees may be demanded based upon consumption of food, alcohol, beverages, water, etc. Security deposits will be returned if and only if all conditions are respected and no damage or other culpable activity is reported. If damage exceeds $50 deposit the responsible party assumes full legal and financial responsibility for damages according to the laws of New York City and State.
Package prices are only guaranteed with a minimum 12 participants. GO NAKED reserves the right to cancel the event at any time. If 12 packages are not secured by September 15, 2017 a full refund will be issued to all parties. GO NAKED does not assume responsibility for airfare or other charges that may be incurred, all parties recognize the need for quantity on this venture and assume personal liability for associated purchases including but not limited to airfare, hotel, travel packages, excursions, rentals, or other items.
Property Owners' Terms
Reservations –There are two types of reservations. High season reservations are those reservations made for the months of December through August. Low season reservations are those for September through November. There are different policies for each of the two.
High season reservations - A 50% initial rental deposit is due at the time the reservation is made. The remaining rental amount balance will be due 60 days prior to the first date of your scheduled occupancy. If the rental amount balance is not received by this time, the reservation will be cancelled and the initial rental deposit amount will be refunded, less any related expense that is incurred. In cases where the reservation is made less than 60 days from the first day of occupancy, the entire rental amount is due at the time the reservation is made. Reservations are tentative until the rental fee has been paid in full for high season rentals.
Low season reservations - A 50% initial rental deposit is due at the time the reservation is made. The remaining rental amount balance will be due upon completion of your stay.
Renter – We will rent to only one responsible party. If there will be more than one party using the property and the charges are to be split between them this is a matter exclusively between the renters. Payment – All charges and payments arising under the rental are to be made in cash or via wire transfer in US dollars or Honduran Lempiras. See the website for details.
Check-in/Check-Out - Check-in time is no earlier than 11:00 a.m. Check-out time is no later than 10:00 a.m. However, early check-in and/or late check-out can be arranged if circumstances allow.
No Shows/Late Arrivals/Early Departures – The Property has been reserved exclusively for your use during the term of your reservation. There are no refunds or credits for no shows, late arrivals or early departures.
Occupancy- Rental rates cover occupancy by up to six people, with additional fees for each guest in addition to that number, as specified on our website.
Cancellations and Refunds - The minimum cancellation notice is 60 days for high season reservations. There is no minimum cancellation notice for low season reservations. As long as the minimum notice requirements have been met, all initial rental deposits are refundable less any costs incurred in making the refund. If the cancellation is made less than 60 days prior to occupancy for high season reservations we will only provide a refund if we are able to find a replacement renter. The amount of the refund will depend on the length of stay of the replacement renter (for example, if the original reservation and payment covered ten days and we are only able to find a replacement renter for six days, then we will only refund an amount equivalent to six days). Any refunds will be made by mailing a US dollar check to the address provided by the renter.
Rescheduling and Changes – Because the Property is held exclusively for you and we do not “double book” reservations, rescheduling a reservation is considered a cancellation of the initial reservation and the creation of a new one. Cancellation policies described above will apply.
Refunds For Events Out of Owner’s Control – We will provide a full refund if the reservation has to be cancelled due to arrival of or threat from a hurricane. A partial refund may be provided, at the discretion of the Jackson family, if arrival is delayed due to other unfavorable weather condition that interrupt international or local transportation.
Damages to Property – The Property and its contents are to be left in clean, undamaged condition. The property has been cleaned and inspected prior to your arrival. The day you arrive, please do a walk-through inspection of the Property. If you notice damage to the Property or its contents please notify the property manager (Barry Jackson) immediately.
For the time that you occupy the property you agree that you are responsible for all damages or loss occurring to the property or its contents caused by your actions or negligence. Note that due to its isolated location obtaining replacement equipment may involve complicated communications, transportation, and import duties that increase the cost.
Linens and towels – Renters are provided with linens and towels for their stay. If renters stay more than one week, clean linens and towels will be exchanged for those that have been used.
Equipment Malfunctions - In case any equipment malfunctions, you should notify the Property Manager (Barry Jackson) as soon as practical via the marine band radio on the Cay or by cell phone to arrange for repairs. Every effort will be made to correct any urgent situation in as little time as possible. Bear in mind that this is a secluded location in Honduras and getting repairs done may take longer than in the more developed countries.
Items Left Behind – We are not responsible for any items you leave behind on the Property. We will ship them to you if you let us know, with reimbursement for shipping costs, or hold them until you return.
Marine Life – The Property is located in an eco-preserve area that harbors different types of marine life in its natural environment. You must respect the ecology and not step on or touch live coral, collect live mollusks, or use spear guns for fishing (prohibited under Honduran law).
Right of Entry – We reserve the right to enter the property at anytime to investigate disturbances, check occupancy, check for damages, make repairs, alterations, and improvements, as we or our agents deem necessary.
Violation of Terms and Conditions – If the renter violates these terms and conditions the Jackson family can terminate the rental at their discretion without providing a refund.
